Terms of Service

PushSense and KumoNotch are free Mac apps written by one person. They run entirely on your Mac, so there is no service to sign up for and no account to lose. These terms are correspondingly short.

Who this is between

"I" and "me" mean Billy Xu, an independent developer. "The apps" means PushSense and KumoNotch, the Mac applications distributed at billyxu.dev, kumonotch.com and through their public releases repositories on GitHub. "You" means the person using them. Downloading or using either app means you accept these terms.

Your licence to use it

The apps are free of charge, for personal and commercial use alike, on as many Macs as you like, with no licence key. I grant you a non-exclusive, worldwide, revocable licence to install and run them.

The source code is not public. You may not redistribute modified builds, resell the apps, or strip out the code signature and ship them as something else. Linking to the download page is always fine and appreciated.

What you produce with it

Your recordings, transcripts, clipboard items and everything else the apps handle are yours. I claim no rights over any of it. Since the apps process everything on your own machine, I never receive that content in the first place.

Your side of it

• Follow the law where you are, including any rules about recording other people.
• Do not attempt to redistribute, resell, or repackage the app as described above.
• If you enable PushSense's optional cloud smart mode, you are responsible for your own API key and for complying with that provider's terms.

No warranty

The apps are provided as is, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. PushSense's speech recognition is imperfect by nature. It will mishear things. Do not rely on it for anything where a transcription error would be costly without checking the output yourself.

Limitation of liability

To the fullest extent permitted by law, I am not liable for any indirect, incidental, special, or consequential damages arising from your use of the apps or this website, including lost data, lost profits, or business interruption. Since the apps are provided free of charge, my total liability to you is limited to zero, which is what you paid.

Third parties

PushSense's speech models are downloaded from Hugging Face, and releases of both apps are hosted on GitHub. If you enable PushSense's cloud smart mode, the provider you select handles your text. KumoNotch’s only network request is a daily update check against GitHub, which you can turn off in Settings. Each of these is governed by its own terms, and I am not responsible for their services or their availability. See the Privacy Policy for what is sent where.

Availability and changes

These are side projects built at night. I make no promise about update frequency, feature requests, or how long downloads will stay available. Future versions may add, change or remove features, and may come with different terms. A copy you have already installed keeps working regardless, because it does not depend on a server of mine.

These terms may change. The date at the top will change with them, and continuing to use the apps after that means you accept the revision.
